By accessing or using the Goose platform, website, and services (collectively, the "Services"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our Services.

We reserve the right to modify these terms at any time. Your continued use of the Services following any changes constitutes your acceptance of the revised terms.

You must be at least 18 years of age to use our Services, including our SMS messaging program. By using our Services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these terms. If you are under 18, you may not use our Services.

Goose is an AI-powered sales coaching and call intelligence platform built for field service and trade businesses, including but not limited to HVAC, plumbing, roofing, and electrical companies.

Our Services may include call recording and transcription, AI call scoring and analytics, practice and training sessions, live call guidance, GPS-triggered auto-recording, manager dashboards and coaching tools, and integrations with third-party CRM systems. Features and availability may vary and are subject to change.

Recording laws vary by jurisdiction, and you and your organization are solely responsible for complying with all applicable laws regarding the recording of calls and conversations, including obtaining any consent required from call participants. Goose provides consent controls and the ability to disable recording features, but does not provide legal advice. You agree to use recording features only where you have the legal right to do so.

Goose offers an SMS/text messaging program as part of our Services. By opting in to receive text messages from us, you agree to the following terms:

Program Description

Our SMS messaging program sends recurring informational and promotional text messages related to our platform, products, and services. Messages may include waitlist updates, product announcements, onboarding information, account alerts, reminders, and offers related to our tools for trade businesses.

Consent and Opt-In

By providing your phone number and opting in through our website form, you expressly consent to receive recurring automated text messages from us. Consent is not a condition of purchase. Your consent applies only to the specific phone number you provide at the time of opt-in.

Message Frequency

Message frequency varies. You may receive multiple messages per week depending on your account activity and product updates. During product launches or special events, message frequency may temporarily increase.

Message and Data Rates

Standard message and data rates may apply to any messages sent or received as part of this program. These rates are determined by your wireless carrier and are your responsibility. Please contact your wireless carrier for details about your messaging plan and any applicable charges.

How to Opt Out

You may opt out of receiving text messages at any time by replying STOP to any message you receive from us. After you send STOP, you will receive a one-time confirmation message. You will no longer receive SMS messages from our program unless you re-subscribe. Opting out of SMS does not affect your account status or access to our other Services.

Carrier Liability Disclaimer

Carriers (including but not limited to T-Mobile, AT&T, Verizon, and others) are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your wireless carrier and is outside our control. We make no guarantee that messages will be delivered on time or at all.

No Sharing of SMS Opt-In Data

We do not sell, rent, share, or otherwise disclose your phone number or SMS opt-in consent data with any third parties or affiliates for their own marketing purposes. Your opt-in information is used solely to send you the messages you have consented to receive.

To access certain features of our Services, you must register for an account or be added to your organization's account. You agree to provide accurate, current, and complete information and to keep it accurate, current, and complete.

You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

You agree not to use our Services to: violate any applicable law or regulation, including laws governing the recording of calls; infringe on the intellectual property rights of others; transmit any harmful, threatening, abusive, or otherwise objectionable material; attempt to gain unauthorized access to our systems or other users' accounts; interfere with or disrupt the integrity or performance of the Services; or collect or harvest any information from the Services without our consent.

Certain features of the Services may require payment. You agree to pay all fees associated with your use of the Services in accordance with the pricing and payment terms presented to you.

All fees are non-refundable except as expressly set forth in these terms or as required by applicable law. We reserve the right to change our pricing at any time, with notice to existing subscribers.

The Services, including all content, features, and functionality, are owned by Built By The Trades and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any of our intellectual property without our express written permission.

You retain ownership of any data you submit through the Services, including call recordings and transcripts. By submitting data, you grant us a limited license to use, process, and store it as necessary to provide the Services to you and your organization.

To the maximum extent permitted by law, Goose and Built By The Trades shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Services.

Our total liability for any claim arising out of or relating to these terms or the Services shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless Goose, Built By The Trades, and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of the Services, your recording of calls, or your violation of these terms.

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms of Service. Upon termination, your right to use the Services will cease immediately.

You may terminate your account at any time by contacting us. All provisions of these terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Your use of our Services is also governed by our Privacy Policy, available at heygoose.com/privacy. The Privacy Policy describes how we collect, use, and protect your personal information, including call recordings, transcripts, and information collected through our SMS messaging program. By using our Services, you consent to the practices described in our Privacy Policy.

These Terms of Service shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the courts located within our principal place of business.
